Legal Considerations of Special Events
A fashion show, trunk show, workshop, or personal appearance can be a fun and profitable break from the everyday rigors of running a business. Because these events are out of the ordinary, you may find there are special regulations that apply.
Before hosting any event, check with your insurance provider to make sure you are covered against accidents, injuries, and property loss or damage. If you usually do not have visitors or employees in your studio, your insurance policy may not cover an open house or workshop. Consider purchasing a temporary supplemental rider to protect you in case an attendee gets hurt at the event.
You may also need to apply for a special license or permit, especially if you do not retail your own designs but will be hosting a retail event. Contact your local or state commerce department to see what forms you will need to complete.
If you will be holding an event off your own premises, make sure the contract addresses the possibility of the venue becoming unavailable or you decide to back out. Negotiate who will pay for the printing and distribution of new advertisements and under what circumstances the deposit is refundable.
If you are holding an event to benefit a nonprofit organization, there may be limitations to what you can say in your advertisements. Let an attorney, either yours or the organization’s, review any marketing material before it is distributed. There may also be local regulations about who can control what parts of the event. For example, your company may not be able to hold a raffle on behalf of a nonprofit organization but you could donate money or merchandise directly to the organization for use as prizes in a raffle. Work with the nonprofit organization, your local government, and your lawyer to make sure your charitable event follows all applicable laws.
If you plan to sell directly to consumers at a personal appearance, workshop, or fashion show, make sure the hosting business or organization approves. Negotiate what percentage of the totals sales income the host should receive. The host may prefer to handle transactions through his or her cash register. If that is the case, make sure the customers know who to contact in case they need to return a garment. A store that carries your current line may only want you to sell samples or discontinued styles. Make sure you are not breaking any exclusivity agreements you have signed with retailers.
